1. Introduction and Acceptance

Welcome to Fartissimo ("Fartissimo", the "Platform", "we", "us", or "our"). Fartissimo is a web platform for a contest of artistic sound video performances — including musical and comedic sound imitation, rhythm, beatboxing, and parody performances where sound is the central creative element.

These Terms of Service (the "Terms") govern your access to and use of the Fartissimo website located at fartissimo.net and all related services, features, and content (collectively, the "Service").

By creating an account, uploading content, voting, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy and Community & Contest Rules, which are incorporated by reference. If you do not agree, do not use the Service.

The Service is operated by RRR FI LP, a limited partnership registered in Scotland under the Limited Partnerships Act 1907, with company number SL034272, whose registered office is at 5 South Charlotte Street, Edinburgh, United Kingdom, EH2 4AN ("Fartissimo"). Contact: [email protected].


2. Eligibility — You Must Be 18 or Older

The Service is strictly for adults aged 18 years or older.

By registering or using the Service, you represent and warrant that:

We do not knowingly permit anyone under 18 to register, upload content, vote, or participate in any contest. If we learn that a user is under 18, we may suspend or delete the account and remove associated content. Content featuring minors as performers is strictly prohibited (see the Community & Contest Rules).


3. Accounts and Registration

3.1 Creating an account

You may register using Google OAuth or an email address and password. Email verification is required. You agree to provide accurate information and to keep it up to date.

3.2 Account security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at [email protected] of any unauthorized use. We are not liable for losses arising from your failure to safeguard your credentials.

3.3 One person, one account

You may not create multiple accounts to manipulate voting, evade a ban, or otherwise circumvent these Terms.


4. User Content and Licensing

4.1 What is "User Content"

"User Content" means videos, titles, descriptions, profile information, and any other material you submit to the Service.

4.2 You keep ownership

You retain ownership of the intellectual property rights you hold in your User Content. We do not claim ownership of your videos.

4.3 Your representations and warranties

By uploading User Content, you represent and warrant that:

You grant Fartissimo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, transcode, adapt (for technical formatting/thumbnails), publicly display, publicly perform, distribute, and promote your User Content for the purpose of operating, providing, promoting, and improving the Service and its contests (including display on contest pages, thumbnails, and promotional materials for the Platform).

This license lasts for as long as your content is on the Service and for a reasonable period afterward needed to remove it from active systems. Removing your content or account ends this license going forward, except: (a) for content already shared or embedded by others where technically applicable, (b) for backups retained for a limited time, and (c) where your content was designated a contest winner and is retained in contest archives.

4.5 Feedback

If you send us suggestions or feedback, you grant us an unrestricted right to use it without obligation to you.

6. Moderation, Content Decisions, and Contests

6.1 Moderation

Uploaded videos are subject to automated (AI) moderation and may additionally be subject to human review. Videos receive a status such as accepted, rejected, or manual review. We may, at our discretion and without prior notice, refuse, remove, hide, restrict, or take down any content that we believe violates these Terms, the Rules, or applicable law, or that we consider harmful, objectionable, or off-brand.

6.2 Reports and automatic hiding

Users may report content. Content that receives multiple independent reports may be automatically hidden pending review, as described in the Rules.

6.3 Appeals

If your video is rejected, you may submit one appeal per video through your dashboard. We will review appeals but are not obligated to reinstate content.

6.4 Contests and voting

Contests run on a weekly cycle. Voting rules include: one vote per user per video, you may not vote for your own video, and only registered users may vote on published videos. We may use anti-fraud measures (rate limits, CAPTCHA/Turnstile, hashed IP and user-agent signals, suspicious-activity scoring). We may disqualify content, votes, or users we reasonably believe engaged in manipulation. Winner selection and any recognition are described in the Rules. The MVP does not offer cash prizes or paid voting.

6.5 No guarantee of publication or outcome

We do not guarantee that any submission will be accepted, published, ranked, or win.


7. Intellectual Property of the Platform

The Service, including its software, design, logos, trademarks, and content we create (excluding User Content), is owned by or licensed to Fartissimo and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended personal, non-commercial purpose, subject to these Terms.


8. Copyright and Infringement Complaints

We respect intellectual property rights and comply with the Copyright, Designs and Patents Act 1988 and applicable notice-and-takedown practice. If you believe content on the Service infringes your copyright, send a notice to [email protected] including: (1) identification of the copyrighted work; (2) the URL/location of the allegedly infringing content; (3) your contact details; (4) a statement that you have a good-faith belief the use is unauthorized by the rights-holder, its agent, or the law; (5) a statement that the information in your notice is accurate and that you are the rights-holder or authorized to act on their behalf; and (6) your physical or electronic signature.

We may remove allegedly infringing content and terminate repeat infringers. The full complaint procedure is described in the Rules.


9. Third-Party Services

The Service integrates third-party services (for example, Google OAuth for login, an AI moderation provider, Cloudflare for storage/CDN, and — subject to your cookie consent — Google Analytics). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services. See the Privacy Policy for more on analytics and cookies.


10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content is accurate or reliable. User Content reflects the views of its authors, not Fartissimo. You use the Service at your own risk.

Nothing in this section excludes or limits any statutory rights you may have as a consumer that cannot be excluded or limited under applicable law, including under the UK Consumer Rights Act 2015. Where the Service is supplied to you as a consumer, any services will be provided with reasonable care and skill as required by law.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fartissimo, its general partner, and their respective directors, officers, employees, and agents will not be liable for any indirect or consequential loss, or for any loss of profits, business, data, goodwill, or anticipated savings, arising out of or relating to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid to us (if any) in the twelve (12) months before the claim, or (b) GBP 100.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of the terms implied by section 49 of the Consumer Rights Act 2015 (reasonable care and skill) or any other liability that cannot be excluded or limited under the law of Scotland. If you use the Service as a consumer, we are not liable for business losses, and your statutory rights are not affected.


12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Fartissimo and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your violation of these Terms or the Rules, or your violation of any law or third-party right.


13. Suspension and Termination

13.1 By you

You may stop using the Service and request account deletion at any time through your account settings or by contacting [email protected]. See the Privacy Policy for how deletion is handled.

13.2 By us

We may suspend, restrict, or terminate your account and remove your content, with or without notice, if we believe you have violated these Terms, the Rules, or applicable law, or to protect the Service, its users, or third parties.

13.3 Effect of termination

On termination, your right to use the Service ends. Sections that by their nature should survive (including content licensing already granted, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.


14. Changes to the Service and to These Terms

We may modify or discontinue the Service (in whole or in part) at any time. We may also update these Terms. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.


15. Governing Law and Dispute Resolution

These Terms, their subject matter, and their formation (and any non-contractual disputes or claims arising out of or in connection with them or the Service) are governed by the laws of Scotland, reflecting Fartissimo's operating entity (RRR FI LP, a Scottish Limited Partnership registered with its principal/registered office in Edinburgh).
